Terms of Service

1. Acceptance

By accessing or using the Services, you confirm that you can form a binding contract with Venglish, you are not barred from using the Services under applicable law, and you will comply with these Terms and all applicable laws.

2. Eligibility and accounts

• You must be at least 13 years old (or the higher minimum age in your jurisdiction, e.g. 16 in much of the EU) to use the Services. Users under 18 should obtain parental or guardian consent.
• If we offer accounts, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
• You must provide accurate information and keep it current.

3. Licence to use the Services

Subject to these Terms, Venglish grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and use the Services for your own non-commercial learning. All rights not expressly granted are reserved.

4. Intellectual property

The Services — including all text, graphics, illustrations, logos, lessons, audio, video, source code, the Venglish brand, and the underlying "Galactic Legend" universe (Venglish, Lexicon, Stardust, V.S.S. LEXICON, STEVE, LEXI, KAI, Hall of Names, and related elements) — are owned by Mr. Vũ Minh Tùng (operator of Venglish) or his licensors and are protected by intellectual-property laws.

The book "The Secrets to Think in English" by (STEVE) Vũ Minh Tùng is offered as a free download for personal study; redistribution requires our written permission.

5. User content

If you submit content through the Services (e.g. messages via the Contact page), you grant us a non-exclusive, worldwide, royalty-free licence to use that content as needed to operate, secure, and improve the Services and to respond to you. You represent that you have the rights necessary to grant this licence and that the content does not infringe any third-party rights or applicable law.

6. Prohibited uses

You agree not to:

• Use the Services for unlawful, fraudulent, or harmful activity.
• Interfere with, disrupt, or impose unreasonable load on the Services or their infrastructure.
• Attempt to access accounts, data, or systems not assigned to you, or to bypass security or rate-limiting measures.
• Reverse engineer, decompile, or extract source code or training data from the Services, except where applicable law expressly permits.
• Scrape, crawl, or harvest content beyond what is permitted by the Services' robots.txt or our written authorisation.
• Use the Services to develop a competing product.

We may suspend or terminate access for violations, with or without notice, in our reasonable discretion.

7. Third-party services

The Services may link to third-party websites or rely on third-party processors (such as Google Analytics and Cloudflare). Venglish is not responsible for third-party content or practices. Your use of those services is governed by the third party's own terms and privacy policies.

8. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT LEARNING RESULTS WILL MATCH ANY EXPECTATION.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VENGLISH AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES. OUR AGGREGATE LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES SHALL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) USD 50.

10. Indemnity

You agree to defend, indemnify, and hold harmless Venglish from and against any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Services, or your violation of any law or third-party right.

11. Termination

You may stop using the Services at any time. We may suspend or terminate your access immediately if we reasonably believe you have violated these Terms or applicable law. Sections that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnity, governing law) will survive.

12. Changes to these Terms

We may update these Terms from time to time. The "Last updated" date at the top indicates when the Terms were last revised. Material changes will be communicated via the Services. Your continued use after changes take effect constitutes your acceptance of the revised Terms.

13. Governing law and disputes

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles. Disputes arising from these Terms will be resolved by the competent courts of Vietnam, except where mandatory consumer-protection rules in your country of residence give you the right to bring proceedings in your local courts.
